1. Introduction

Welcome to Hour Cap. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service. These terms are governed by the laws of Queensland, Australia.

2. Service & Registration

Hour Cap provides time tracking and project management services. To access the service, you must register an account and provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to the service or its related systems
  • Interfere with or disrupt the integrity or performance of the service
  • Upload or transmit any malicious code, viruses, or harmful data
  • Reproduce, duplicate, copy, sell, or exploit any portion of the service without express permission

4. Privacy

Your use of the service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the service, you consent to the practices described in the Privacy Policy.

5. Subscriptions & Payments

Hour Cap offers free and paid subscription plans. Paid subscriptions are billed in advance on a recurring basis. You may cancel your subscription at any time, and cancellation will take effect at the end of your current billing period.

Under the Australian Consumer Law, you have the right to cancel your subscription within 14 days of your initial purchase for a full refund if the service has not been substantially used. To request a refund, please contact us by email.

6. Intellectual Property

All intellectual property rights in the service, including but not limited to software, design, text, and graphics, are owned by Hour Cap or its licensors. You may not reproduce, modify, distribute, sell, or create derivative works based on the service without prior written consent.

You retain ownership of all data and content you submit to the service. By using the service, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the service to you.

7. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

8. Limitation of Liability

To the maximum extent permitted by law, Hour Cap shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

9. Termination

We may suspend or terminate your access to the service at any time, with or without cause, and with or without notice. Upon termination, your right to use the service will immediately cease. You may request a copy of your data prior to account deletion.

10. Changes to These Terms

We reserve the right to update these terms at any time. We will notify you of any material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the service after changes are posted constitutes your acceptance of the revised terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
